Overview
Welcome to GlowMories. The terms “we”, “us” and “our” refer to GlowMories. We operate this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify. By visiting, using or buying from the Services, you agree to these Terms of Service (“Terms”) and our Privacy policy. If you do not agree, please do not use the Services.
1. Access and account
By using the Services, you confirm that you are at least the age of majority in your country, state or province. You agree to give us accurate, complete and current information, and you are responsible for keeping your account details secure. Your account cannot be transferred to anyone else.
2. Our products
We try to show our products as accurately as possible. Colors, brightness and size of the projection can look different depending on your screen, the photo you upload, the car and the lighting conditions. The projector is a light: the projection looks best in the evening, at night or in a garage and is much weaker in bright daylight. We may change product descriptions or stop offering a product at any time, and we may limit quantities per person or region.
3. Personalized products and your content
Our projectors are made with the photos and text you upload (“Your Content”). By uploading Your Content you confirm that:
- you own the photo or have permission to use it, including permission from the people shown in it;
- Your Content does not infringe anyone's copyright, trademark, privacy or other rights (for example, brand logos, cartoon or movie characters, or photos of celebrities);
- Your Content is not illegal, offensive, hateful, sexual or violent.
We may refuse or cancel an order with Your Content that breaks these rules; in that case we will refund you in full. We use Your Content only to produce and support your order, and we never publish it without your permission. Please check your photo and text before ordering: we produce the projection exactly as uploaded.
4. Orders
When you place an order, you are making an offer to buy. We confirm acceptance by email once payment has been received. We may decline or cancel any order, for example if a product is unavailable, if there is an error in price or description, or if we suspect fraud; if you have already paid, we will refund you in full. Cancellations and refunds are described in our Refund policy. Products are sold for personal use and not for resale.
5. Prices and payment
Prices and promotions may change at any time. The price you pay is the price in effect when you place your order, as shown in your order confirmation. Prices are shown in your local currency where available. Promotions such as bundle prices or Black Friday offers may have their own conditions, which apply in addition to these Terms. You agree to provide valid payment information and authorize us to charge the total amount of your order.
6. Shipping and delivery
Shipping is free. Delivery times are estimates only, and we are not responsible for delays caused by carriers, customs or events outside our control. Details, including the optional Skip the Line and Shipping Protection add-ons, are in our Shipping policy. For orders outside the European Union, the risk of loss passes to you when the products are handed to the carrier, unless you purchased Shipping Protection. For consumers in the European Union, the risk passes to you only when you receive the products.
7. Intellectual property
The Services, including our name, logo, designs, photos, videos and texts, belong to GlowMories or our licensors and are protected by intellectual property laws. You may use the Services only for personal, non-commercial purposes. You may not copy, modify, distribute or create derivative works from our content without our written permission. Your Content remains yours.
8. Third-party tools and links
The Services may include tools or links provided by third parties. These are provided “as is”, and we are not responsible for third-party websites, content, products or services. Any complaints about third-party products should be directed to the third party.
9. Relationship with Shopify
Our store is hosted on Shopify, but all sales are made directly between you and GlowMories. Shopify is not responsible for the sale or delivery of our products.
10. Privacy
How we collect and use your personal information is described in our Privacy policy.
11. Reviews and feedback
If you send us reviews, photos of your projector, ideas or other feedback, you allow us to use them to improve and promote our products, but we will only publish your name or photos with your permission. You confirm that your feedback is truthful and does not break anyone's rights.
12. Errors
Occasionally there may be errors in prices, descriptions or availability. We may correct them and update or cancel affected orders, even after you have submitted them. If we cancel a paid order, we refund you in full.
13. Prohibited uses
You may use the Services only for lawful purposes. You may not harass others, provide false information, send spam, impersonate anyone, copy or resell the Services, collect other users' personal data, or interfere with the security or operation of the Services. Using bots, scrapers or other automated tools to access the Services without our permission is not allowed. Any automated agent acting on someone's behalf must identify itself honestly and must not bypass our security measures. We may suspend or end access for anyone who breaks these rules.
14. Termination
We may end these Terms or your access to the Services at any time. You remain responsible for any amounts owed. Sections that by their nature should continue (such as intellectual property, liability and governing law) will survive termination.
15. Disclaimer
Except as expressly stated in these Terms and our policies, and to the extent permitted by law, the Services are provided “as is” and “as available”. This does not limit any rights you have as a consumer under mandatory law, including the statutory guarantee for faulty goods.
16. Limitation of liability
To the fullest extent permitted by law, GlowMories is not liable for indirect or consequential damages arising from your use of the Services or products, and our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded by law, including your statutory rights as a consumer.
17. Indemnification
You agree to compensate us for claims by third parties caused by your breach of these Terms or by Your Content (for example, if you upload a photo you had no right to use).
18. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the policies posted on our website, are the entire agreement between you and us. Our failure to enforce any right is not a waiver of that right. Section headings are for convenience only.
19. Governing law
These Terms are governed by the laws of Poland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country.
20. Changes to these Terms
We may update these Terms from time to time by posting the new version on this page. The version in effect when you place your order applies to that order.
